Terms of Service

Eligibility

You must be at least 18 years old, or authorized to bind the business you're representing, to purchase any paid service from Hardened.

Repository ownership and authorization

By submitting a repository URL — whether for a free scan or a paid engagement — you represent that you own the repository or have the authorization of its owner to have it scanned and, where applicable, modified.

If that representation turns out to be false, you agree to indemnify and hold Hardened harmless from any claims, damages, or losses arising from our having scanned or worked on a repository you weren't authorized to submit.

Nature of the service

Our scanning is automated and best-effort. It can produce false positives (flagging something that isn't actually a problem) and false negatives (missing something that is). A scan that finds nothing is not a guarantee that an application is secure — it means we didn't find anything within the scope and limits of that scan.

Paid fixes and reviews are performed by a person, but no security work of any kind can guarantee an application will never be compromised.

Confidentiality of results

Scan results and findings are confidential to the person or business that requested them. We never publish, share, or disclose your results to anyone else, except where you've asked us to (for example, sharing a report with your team) or where required by law.

Fees and payment

Fees for paid services are listed on our pricing page at the time of purchase. Payment is processed by Stripe; we don't store your payment card details ourselves.

Refusal and suspension of service

We may refuse, pause, or suspend service to anyone, for any reason, including if we believe a repository was submitted without proper authorization, if we suspect abuse of the free scan tool, or if continuing would put us or others at risk.

Limitation of liability

To the maximum extent permitted by law, Hardened's total liability to you for any claim arising from these terms or our services is limited to the amount you actually paid us for the service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

Changes to these terms

We may update these terms from time to time. We'll update the date at the top of this page when we do. Continued use of our services after a change means you accept the new terms.

Governing law

These terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles. Any dispute arising from these terms or our services will be resolved exclusively in the state or federal courts located in Cuyahoga County, Ohio, and you consent to that venue.
